immigration

The recent detainment of a Georgetown University Graduate Student, by ICE, has sparked major concerns, once again, though the universities and immigration communities. This incident highlights the precarious position of international students in the US and has brought a dark undertone on visa regulations. It also raises questions regarding the balance between national security and the rights of individual freedoms when pursuing higher education.

The following will further explain the detainment of Badar Khan, the potential consequences of student visa revocations, and how KAASS LAW can help.

The Detainment of Badar Khan

Badar Khan Suri is an Indian national, a graduate student, and a teacher at Georgetown University. Department of Homeland Security and ICE have accused him of having close connections with a known or suspected terrorist and also spreading Hamas propaganda. Badar’s attorney has denied any of the allegations and claims that he was targeted due to his wife being a Palestinian. Department of Home Security informed Badar that they revoked his visa and that he was not facing expulsion from the US.

Yet another similar arrest, but not exact, occurred with the arrest of Mahmoud Khalil. These recent arrests of students have been raising concerns all around the nation that this is potentially overreaching and needs proper due process. Ideally, International Students are usually vital contributors to the nation’s academics and cultural landscape. Their presence provides an enrichment to our communities. When facing detention disrupts their lives, education, and the community.  This is a stark reminder of the potential consequences, or even visa infractions,  and thus, the need to take proactive measures to ensure compliance.

Understanding Student Visa

Visa comes with specific requirements that students must adhere to, including:

  • Full-Time Enrollment: People enrolling must be full-time students in order to be accepted into the academic program.
  • Valid I-20: The form, issued by the designated school official (DSO), certifies the student’s eligibility for an F-1 visa.
  • Compliance with Employment Regulations: F-1 students are generally prohibited from working off-campus without authorization.
  • Maintaining Valid Status: Students must ensure their visa and I-20 remain valid throughout their stay.
  • Reporting Changes: Students must promptly report any changes to their address, program of study, or other relevant information to their DSO.

Detention

Several cases and factors that potentially lead to the detention of an international student can happen by the following:

  • Visa Violations: Sometimes student can break a Visa violation due to not being a fulltime student. This also includes working somewhere unauthorized.
  • Criminal Convictions: From minor infraction, to a serious matter. This can revoke your Visa, given the circumstances.
  • Security Concerns: In some cases, students may be detained due to suspected national security issue.
  • Administrative Errors: Mistakes and or errors in documentation can lead to detention.
  • Overstaying a Visa: Remaining in the US past the date authorized on the I-94.

The Importance of Legal Representation

When an international student is under detainment, having experienced legal representation is crucial. An attorney can:

  • Investigate: We can attempt and determine the specific reasons for the detention and identify any potential errors or violations of due process.
  • Advocate for Release: Work to secure the student’s release from detention, either through administrative action or legal proceedings.
  • Address Visa Violations: Help students rectify any visa violations and pursue options for reinstatement of status.
  • Represent: Provide representation in deportation proceedings and explore potential defenses or forms of relief.
  • Ensure Due Process: Protect the student’s rights and ensure they receive fair treatment under the law.
  • Communicate with the University: Work with the university’s international student office to coordinate efforts and provide necessary documentation.
