The New Legislation: A Closer Look

H.B. 226 Criminal Amendments is a bill that, in simplest terms, “addresses criminal offenses and repercussions from those offenses”.  Furthermore, the following bill goes into detail by highlighting the following that it:

  • requires a county sheriff to notify and coordinate with the relevant federal immigration
    authority when preparing to release from the county jail an individual who:

    • is being released after serving the individual’s jail sentence for certain class A
      misdemeanors or a felony; and
    • is unlawfully present in the United States;
  • requires the Department of Corrections to notify and coordinate with the relevant federal
    immigration authority when preparing to release an inmate who:

    • is being released after serving a term of imprisonment for a felony; and
    • is unlawfully present in the United States;
    • amends the sentence of imprisonment for a class A misdemeanor to one year for certain
      offenses;
  • amends certain pretrial release provisions to add a rebuttable presumption that an
    individual is a flight risk if the individual is not lawfully present in the United States; and
  • makes technical and conforming changes.

The Impact on Legal Immigrants and Risk of Deportation

One of the most significant concerns surrounding the new legislation is its potential impact on legal immigrants. Critics argue that the broad language of the law could lead to the deportation of individuals who have lawful permanent resident status or other legal immigration status. This could include individuals who have committed minor offenses or who have lived in the U.S. for many years, contributing to their communities and families.

Specifically, the expansion of “criminal offenses” that can lead to deportation creates a risk for legal immigrants who may have made minor mistakes in the past. This could include traffic violations, minor drug offenses, or other infractions that previously would not have jeopardized their immigration status.

Furthermore, the streamlined removal process could limit the ability of legal immigrants to effectively defend themselves in deportation proceedings. This could lead to wrongful deportations and a denial of their rights.
